Data protection information for the application process
Purposes of processing and legal basis
Your application data (including master data and contact data, curriculum vitae, proof of qualifications, copies of certificates, details of driving licence, certificate of good conduct if applicable, details of severe disability if applicable) will be collected by the relevant contact persons exclusively for the purpose of processing your application exclusively with you and processed by the above-mentioned companies. The provision of personal data is necessary for the legitimacy of the selection procedure to be carried out as well as the subsequent processing of the contract. The scope of the data processed depends on the content of your application documents. We process your applicant data on the basis of Art. 88 para. 1 GDPR in conjunction with § 26 para. 1 BDSG as well as Art. 6 para. 1 sentence 1 lit. b) GDPR. Insofar as special categories of personal data within the meaning of Art. 9 para. 1 GDPR are processed within the scope of the application procedure, this is done on the basis of Art. 26 para. 3 BDSG. Any further data processing (e.g. for the storage of personal data in the talent pool) is carried out on the basis of your consent pursuant to Art. 6 para. 1 sentence 1 lit. a) GDPR or § 26 para. 2 BDSG. You will be informed of this in each case. Consent is voluntary; refusal to give consent will not result in any disadvantages.
Recipients
Recipients of the personal data contained in the application documents are the employees in the human resources department of Communardo Software GmbH, the respective responsible HR managers and internal employees of Communardo Group GmbH, Communardo Software GmbH and Communardo Products GmbH involved in the application process. Where necessary, we have concluded contracts with the service providers we use (e.g. providers of SaaS solutions) for processing in accordance with Article 28 of the GDPR.
Further information on joint controllers
The above-mentioned companies have defined their obligations under data protection law within the framework of an agreement within the meaning of Article 26 para. 1 GDPR. On the basis of this agreement, Communardo Software GmbH is responsible for providing data protection information in accordance with Articles 13 and 14 GDPR. Furthermore, Communardo Software GmbH ensures the exercise of the rights of data subjects. Notwithstanding the foregoing, data subject rights may also be asserted directly against each of the designated companies. In this case, the respective company will immediately forward the request to the data protection officer of Communardo Software GmbH for further processing.
With regard to ensuring the lawfulness of the processing of personal data, the security of the processing and the maintenance of internal data protection documentation, the designated companies are each responsible for their own actions.
Intention of transfer to third countries and legal basis
No personal data is transferred to a third country or to an international organisation.
Automated individual decision-making and profiling
We do not carry out automated individual case decision-making or profiling.
Duration of processing
The deletion of the transmitted personal data takes place if you withdraw your application or if we are unable to offer you a vacant position, at the latest six months after the end of the application process. This does not apply if legal provisions prevent deletion or if further storage is necessary for the purpose of providing evidence or if you have consented to longer storage. Your consent in this regard can also be revoked by you at any time with effect for the future. The relevant data will then be deleted immediately. If your application is followed by the conclusion of a contract with us, we will process your data for the purpose of the organisational and administrative process and in compliance with the legal provisions for the purpose of the employment relationship.
Notice of data subject rights
Data subjects may at any time request information about the personal data concerning them and, if necessary, request rectification or deletion or restriction of processing, or object to processing. There is also a right to data portability. Furthermore, if the data processing is carried out on the basis of consent, this can be revoked at any time for the future. To exercise your rights, Communardo Software GmbH and its data protection officer are available to you at the above contact details.
Right to complain to a supervisory authority
There is a right for every data subject to lodge a complaint with a data protection supervisory authority pursuant to Art. 77 DS-GVO if it is suspected that the processing of the personal data is carried out unlawfully.
